Terms & Conditions

The terms that apply when you use this website or place an order with Safiery. Please read them alongside our Warranty & RMA page.

1. Acceptance of these Terms

These Terms & Conditions ("Terms") govern your access to and use of this website (the "Website") and any purchase of products from Safiery Pty Ltd. By browsing the Website or placing an Order, you agree to be bound by these Terms. If you do not agree with them, please do not use the Website or place an Order.

2. Definitions

In these Terms:

  • "Safiery", "we", "us" or "our" means Safiery Pty Ltd.
  • "you" or "your" means the person or business using the Website or placing an Order.
  • "Website" means this website and any related storefront operated by Safiery.
  • "Products" means the goods offered for sale on the Website, including Safiery-manufactured products and third-party products we distribute.
  • "Order" means a request to purchase Products submitted by you through the Website, by phone or by email.

3. Eligibility & use of the website

You may use the Website only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Website by, anyone else. You must be legally capable of entering into a binding contract to place an Order.

If you create an account, you're responsible for keeping your login details confidential and for all activity that occurs under your account. Let us know straight away at sales@safiery.com if you suspect any unauthorised use.

4. Products, descriptions, pricing & availability

Prices shown on the Website are in Australian dollars (AUD) and, unless stated otherwise, are inclusive of GST where GST applies. Prices reflect our recommended retail price (RRP) at the time of display and may change without notice.

We take care to describe and photograph our Products accurately, but images, colours and finishes may vary slightly from the Product you receive due to display settings, manufacturing batch variance or photography conditions. Specifications may be updated by manufacturers from time to time.

Occasionally a Product's price or description may be listed in error. If we discover a pricing or description error on an Order you've placed, we'll contact you before proceeding — you'll have the choice to continue at the correct price/description or cancel with a full refund.

Displaying a Product on the Website does not guarantee availability. Stock is confirmed only once we accept your Order.

5. Orders & payment

Placing an Order is an offer by you to purchase the Products at the listed price. No contract exists until we accept your Order — acceptance happens when we confirm the Order (for example, by dispatch confirmation or order confirmation email), not simply when payment is taken.

We may decline or cancel an Order — before or after acceptance — for reasons including stock unavailability, pricing or description errors, suspected fraud, or if we're unable to verify your payment or identity. Where we cancel an Order after payment, we'll refund you in full.

Payment is required using one of the methods offered on the Website at checkout. We (or our payment providers) may carry out reasonable verification or fraud checks on any Order before it is accepted or dispatched.

6. Shipping & delivery

Delivery timeframes shown on the Website or quoted to you are estimates only and are not guaranteed. Delays can occur due to carrier delays, remote locations, stock availability or circumstances outside our control.

Risk in the Products (loss or damage) passes to you on delivery to the address you provide. Ownership and title in the Products remain with Safiery until we have received payment in full.

7. Change-of-mind returns

This section covers change-of-mind returns and is separate from warranty or fault claims — see Section 8 for those.

If you simply change your mind about a purchase, contact us at sales@safiery.com within 30 days of delivery. To be eligible for a change-of-mind return, the Product must be:

  • unused and in as-new condition;
  • in its original packaging with all accessories, manuals and documentation; and
  • in a resaleable condition.

For change-of-mind returns, you're generally responsible for the cost of returning the Product to us, and freight/shipping charges already incurred on the original Order are non-refundable. Once we've received and inspected the returned Product, we'll process your refund using your original payment method (or another method we agree with you).

Custom-built, made-to-order or special-order items (for example, Products configured or manufactured to your specification) are not eligible for change-of-mind return.

8. Warranty, faults & returns

Safiery Products are backed by warranty. A summary of our standard warranty periods and exclusions is below — the full self-service warranty terms and the step-by-step process for lodging a claim (including our online warranty request form) are on our Warranty & RMA page.

  • Standard warranty: 24 months from date of purchase, covering manufacturing defects under normal use.
  • Safiery Solid State Lithium battery packs: 5-year warranty from date of purchase.
  • Not covered: misuse, unauthorized modification, water ingress beyond the Product's rated ingress protection, and normal wear items.
  • Third-party products (for example, Victron) follow that manufacturer's own warranty process.

No advance replacement

Safiery does not provide advance replacement. We will not ship a replacement unit ahead of, or during, assessment of a returned Product, under any circumstance. No loaner units or advance-swap units are provided.

Return-to-base only

All warranty, fault, return and refund claims are handled strictly on a return-to-base basis. This means the Product must be shipped back to Safiery (or to a location we nominate) and inspected by us before any remedy — repair, replacement, refund or credit — is provided or actioned. We do not offer on-site or in-field replacement or swap of Products.

To start a claim, submit a request with your invoice number via the Warranty & RMA page. You'll receive a warranty reference (e.g. WR-000123), we'll review it against your purchase and the warranty terms above, and — if it's covered — we'll authorise the return and send you instructions on where to send the unit and how to pack it. Once the returned unit arrives we inspect it and complete the outcome (repair, replacement or credit) before dispatching it back to you.

9. Australian Consumer Law

Nothing in these Terms — including the return-to-base and no-advance-replacement provisions in Section 8 — excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law (or any other applicable law) that cannot lawfully be excluded, restricted or modified. Those provisions describe how a remedy is delivered — the process and logistics we follow — not whether a remedy is owed to you.

Our Products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Products repaired or replaced if the Products fail to be of acceptable quality and the failure does not amount to a major failure.

10. Limitation of liability

To the extent permitted by law, Safiery's liability for any loss or damage arising out of or in connection with these Terms, the Website or any Product is limited, at our option, to the repair or replacement of the Product, the supply of an equivalent Product, or the cost of doing so. To the extent permitted by law, Safiery excludes all liability for indirect, special or consequential loss, including loss of profits, loss of revenue or loss of use, arising from your use of the Website or any Product. Nothing in this section limits any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

11. Indemnity

To the extent permitted by law, you agree to indemnify and hold Safiery, its officers, employees and agents harmless from any claim, loss, damage or expense (including reasonable legal costs) arising from your misuse of the Website, your breach of these Terms, or your violation of any law or the rights of a third party.

12. Intellectual property

All content on the Website — including text, graphics, logos, product images, branding and the layout and design of the Website itself — is owned by Safiery or our licensors and is protected by copyright, trade mark and other intellectual property laws. You may not reproduce, distribute or otherwise use any part of the Website's content for commercial purposes without our prior written consent.

13. Third-party links & content

The Website may contain links to third-party websites (for example, manufacturer sites) or reference third-party products. We don't control and aren't responsible for the content, accuracy or availability of third-party websites, and including a link doesn't imply our endorsement of it.

14. Privacy

We handle your personal information in accordance with the Privacy Act 1988 (Cth). If you have questions about how we collect, use or store your information, contact us at sales@safiery.com.

15. Force majeure

Safiery isn't liable for any delay or failure to perform its obligations under these Terms where that delay or failure results from circumstances beyond our reasonable control, including natural disasters, carrier or freight disruptions, supplier failures, industrial action, or government action.

16. Governing law & jurisdiction

These Terms are governed by the laws of Queensland, Australia. You and Safiery both submit to the non-exclusive jurisdiction of the courts of Queensland, Australia in relation to any dispute arising out of these Terms.

17. Severability

If any part of these Terms is found to be invalid, illegal or unenforceable, that part will be severed and the remaining provisions will continue in full force and effect.

18. Changes to these Terms

We may update this page from time to time — for example, to reflect changes in our processes or the law. The version of these Terms in effect at the time you place an Order applies to that Order. We recommend checking this page periodically.
